These Terms of Use (“Terms”) govern your access to and use of the TalkActive mobile application and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. The Service

TalkActive lets you discover, create, and chat with AI characters, request AI-generated images, and use related features such as credits and optional voice dictation.

The Service is provided for entertainment and personal use. AI characters are fictional and computer-generated. Outputs may be inaccurate, incomplete, or unsuitable.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your country) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activity under your account
  • Providing accurate information

We may suspend or terminate accounts that violate these Terms or create risk for users or the Service.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful, harmful, harassing, or fraudulent purposes
  • Attempt to exploit, reverse engineer, or disrupt the Service
  • Upload or request content that infringes others’ rights
  • Impersonate others or misrepresent your identity
  • Use the Service to create or distribute sexual content involving minors (including fictional depictions)
  • Scrape, bulk-export, or automate access in ways that overload or abuse the Service
  • Circumvent safety, billing, or access controls

We may remove content, limit features, or terminate access when we reasonably believe a violation has occurred.

5. User content

You retain rights to content you create. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content as needed to operate and improve the Service (including AI processing).

You are responsible for the content you submit. Do not submit confidential or sensitive personal data.

6. AI-generated content

AI outputs are generated automatically and may not reflect our views. You are responsible for how you use AI outputs. Do not rely on the Service for professional advice (medical, legal, financial, or otherwise).

7. Purchases, credits, and subscriptions

Some features require in-app purchases or credits. Purchases are processed by Apple App Store or Google Play and are subject to their terms.

Unless required by applicable law or the relevant store’s refund rules:

  • Purchases and consumed credits are generally non-refundable
  • Credits have no cash value and are not transferable
  • Prices and offer availability may change

If you believe a charge is incorrect, contact the store first, then email contact@monovi.com.tr with your purchase receipt details.

8. Intellectual property

The Service, including software, branding, design, and non-user content, is owned by Monovi or its licensors. These Terms do not grant you ownership of the Service.

9. Third-party services

The Service may rely on third-party platforms (for example authentication providers, app stores, cloud hosting, and AI providers). Their terms and privacy policies apply to their services.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE OR APPROPRIATE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONOVI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD 50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnity

You agree to indemnify and hold harmless Monovi from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms.

13. Termination

You may stop using the Service at any time and may delete your account in Settings. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that should survive termination will survive (including ownership, disclaimers, and liability limits).

14. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you. Continued use after the effective date means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
